United States v. SW (District of New Jersey)

Our Client was a legal permanent resident, who was arrested years after having pled guilty to a felony crime (while being represented by another law firm). He was placed into deportation proceedings before the U.S. Immigration Court. After proceedings lasted for nearly two years with numerous other attorneys, Michael Orozco, Esq. filed a Habeas Corpus petition in the United States District Court of New Jersey, charging the Department of Homeland Security, the United States Attorney General, and the Warden of the Jail with depriving our client of his constitutional rights. Less than one month after filing our petition, the government conceded the legal arguments contained in our papers; and, the Client was released without having to pay any bail or fines.

United States v. HT (Northern District of Illinois; Eastern District of N.Y.)

Our Client was a 'Shock-Jock', who was charged with threatening the lives of three Federal Appellate Judges from the 7^th U.S. Circuit Court of Appeals, with the charges originally filed in the U.S. District Court, Northern District of Illinois. Once Michael Orozco, Esq. entered his appearance, he successfully moved the case from Illinois to the U.S. District Court, Eastern District of New York, arguing that our client could not receive a 'fair trial' in the same Illinois Courthouse where the Appellate Judges sit; and, obtained the release of our client from federal custody. The case was tried to a jury, with the jury declaring that they were 'hopelessly deadlocked', after which the trial judge declared a mis-trail and set a new trial date. NOTE: Obviously, a not-guilty verdict was what the defense would have preferred, but the fact that the jury deadlocked at 9-3 for acquittal, was a strong moral victory for the client's asserted defense of 'Freedom of Speech', as the vast majority of federal criminal trials conclude with a guilty verdict.

United States v. HT (II) (Eastern District of New York)

The U.S. Attorney decided to re-try the case against our Client, and after a second trial, the jury was again hopelessly deadlocked, with the Judge declaring another mis-trial. This verdict was obviously, again, not the verdict the client or Mr. Orozco wanted; but, again, it was a strong moral victory for the defense of 'Freedom of Speech', as the U.S. Attorney made every effort to convict the client, to include calling the three 'threatened' Federal Judges as witnesses. NOTE: Given the fact that the vast majority of federal criminal trial result in a guilty verdict and the 'full-court press' by the prosecution, the 'hung jury' was a result that precluded the government from convicting our client. Unfortunately, the U.S. Attorney intends to continue attempting to prosecute the client with yet another trial.

United States v. DR-A (Southern District of New York)

Our Client was charged with Conspiracy to Possess and Distribute 20-Kilos of Cocaine. After he was arrested, on advice of another counsel, the client confessed to these crimes. Also while represented by another counsel, the client provided a proffer to the federal government reiterating his confession, admitting to the crimes. Bailey & Orozco was then retained to represent the client and we began a vigorous and aggressive defense, seeking a retraction of the confessions. After repeated discussions with the United States Attorney's Office, Michael Orozco, Esq. persuaded the prosecutor handling the matter to dismiss the warrant and vacate all charges against the client. NOTE: This type of disposition (a complete dismissal) is an extreme rarity in the federal criminal justice system. In this case, the dismissal was achieved due to unique factual circumstances which had not been addressed until Bailey & Orozco was retained to represent the client.
