Outcome: 1st Degree Drug Racketeering Wiretap Case - All Charges Dismissed

Description: Wiretap Racketeering Trial with extensive Electronic Surveillance evidence issues. The client was charged as an accomplice in a large-scale prescription fraud case involving more then a dozen defendants, including a Doctor who wrote bogus prescriptions which were used to obtain prescription medications. If convicted of the charge, client was exposed to a sentence of Life, and a minimum sentence of at least 15 years, with parole ineligibility. We conducted extensive Motion practice contesting the investigation; the seizure of phone calls; and, the seizure of evidence by search warrants. Jury selection was completed after 14 days of selection. Audibility (Driver) hearings on the recorded telephone communications were conducted lasting approximately 4 weeks, with all attorneys and their clients listening to the recorded conversations. During the pre-trial arguments we were able to emphasize the likely acquittal of our client after trial, and convinced the State that if some of the defendants were to plead guilty and exculpate our client, that the State should consider severing and dismissing the charges against our client. Several defendants did plead guilty and as a result the State severed all charges against our client. The charges against our client were dismissed at the sentencing of the codefendants.
