State of New Jersey v. AG
Original Charge: 1st Degree Possession with Intent to Distribute - 7 lb of Hashish
Outcome: No-Plea PTI Diversion & No Deportation
Description: Client was charged with the Possession with Intent to Distribute of 7 pounds of Hashish. This 1st degree crime exposed the client to a prison sentence of 10-20 years, with at least 3 years of parole ineligibility. Once he was released from Prison, he would have been immediately deported, since he was not a US Citizen. Based on successful defense arguments, the Prosecutor agreed to divert the client into the Pre-trial Intervention (PTI) program, for a twelve month period. Significantly, since no plea was required, the client will not be deported, and can get this expunged 6 months after the client completes the PTI diversion.
No conviction; No deportation; and soon, No Record.
